JVAP Follow-up portal

Privacy statement

 

The JVAP Follow-up portal has been developed in the framework of the Joint-Valletta Action Plan (JVAP) Follow-up, a component of the EU funded project “Support to the Africa-EU Migration and Mobility Dialogue” (MMD).

This portal is edited by the International Centre for Migration Policy Development (“ICMPD”) under the responsibility of the European Commission.

These General Terms and Conditions apply to all JVAP Follow-up portal users (each “User” and collectively, the “Users”) having signed up on the JVAP Follow-up portal.

 

Registration

By registering, Users are submitting a request to ICMPD to receive an access to their personal account on the JVAP Follow-up portal under the terms and conditions set out below. After ICMPD has received the request, ICMPD will verify its validity before approval and granting access to Users.

By signing up, Users can access their personal account on the JVAP Follow-up portal. Once logged into their personal account, Users can be redirected to:

  • The JVAP Database (software: FileMaker)
  • JVAP data visualisations (software: Microsoft Power BI)
  • Training materials
  • Additional resources such as latest publications and reports

Until further notice, the JVAP Follow-up portal sign up option is limited to JVAP Partners only. JVAP Partners are representatives from the countries and organisations from the Khartoum and Rabat Processes.

This registration procedure has been approved by the donor based on consultations of the JVAP Partners. . Any variation shall require further approval.

 

General Terms and Conditions for Users

1. Copyright

Content displayed on the JVAP Follow-up portal logged-in area – and the platforms it enables Users to be redirected to (FileMaker, Microsoft Power BI) to – is subject to copyright. Reproduction of any and all elements of the JVAP Follow-up portal logged-in area and the platforms it redirects to is not authorised without the prior written authorisation of ICMPD as administrator. The JVAP Follow-up portal logged-in area and the platforms it redirects to shall not be reproduced or publicly disseminated. Any element of the JVAP Follow-up portal logged-in area and the platforms it redirects to, including, but not limited, to reports, records and data, charts, images, videos or other uploaded documents from the JVAP Follow-up portal logged-in area and the platforms it redirects to, and interpretations thereof is not intended and shall not be used for advocacy or lobbying activities of and by Users.

 

2. Intellectual property license and third-party claims

Each User grants ICMPD and the European Commission a license to use and sublicense all intellectual property – included without limitation copyrights – with regards to any input added to the JVAP Follow-up portal logged-in area and the platforms it redirects to by them.

Users shall indemnify and hold harmless ICMPD and its employees from and against any and all suits, actions or administrative proceeds, claims, demands, losses, damages, costs and expenses of any nature, which ICMPD may suffer as a result of any infringement or alleged infringement of any registered design, trademark, copyright or other intellectual property right registered or otherwise existing which prohibits or otherwise prevents the use of their input in the JVAP Follow-up portal logged-in area and the platforms it redirects to for the purposes set out herein.

 

3. Access, security and password

Upon agreement to this privacy statement and approval of the registration and, Users shall have access to the logged-in area on the JVAP Follow-up portal by creating their own password.

ICMPD aims to minimise access disruption caused by technical errors. However, some data on the JVAP Follow-up portal logged-in area and the platforms it redirects to, may have been created or structured in files or formats that are not error-free. ICMPD accepts no responsibility with regard to such problems incurred as a result of using this portal or any linked external webpage.

Any password used for accessing the JVAP Follow-up portal logged-in area and the platforms it redirects to, is owned by each User and must not be shared or transmitted, even temporarily to any third party. ICMPD is neither responsible for Users´ use of passwords for accessing the JVAP Follow-up portal logged-in area and the platforms it redirects to, nor for the security of the workstation used when connecting to the JVAP Follow-up portal logged-in area and the platforms it redirects to. Any and all Users shall be responsible for the security of the workstation used when connecting to the JVAP Follow-up portal logged-in area and the platforms it redirects to, and shall take all necessary measures to avoid interception of the information accessible through it (e.g. anti-spyware, antivirus, auto lock feature, etc.).

The access log to the JVAP Follow-up portal logged-in area and the platforms it redirects to, shall be kept by ICMPD as administrator for operational management and security.

 

4. Infringement

In case of infringement of these Terms and Conditions or other irregularities related to the use of the the JVAP Follow-up portal logged-in area and the platforms it redirects to, ICMPD, as administrator, shall be immediately informed: jvapfollowup@icmpd.org.

ICMPD reserves the right to investigate and take appropriate administrative and legal actions against those not complying with this privacy statement. ICMPD, upon informing the Secretariat of the Khartoum and Rabat Processes, may terminate JVAP Follow-up portal logged-in area Users´ access without prior notice.

 

5. Use of Microsoft Power BI

Microsoft Power BI is a Microsoft business analytics service, which supports Users in using and developing data visualisations. Microsoft complies with leading data protection and privacy laws applicable to Cloud services, and its compliance with world-class industry standards is verified by third parties. As with all its Cloud services products, Power BI is enabled to help ICMPD comply with national, regional, and industry-specific laws and regulations.

ICMPD is committed to compliance with Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data (“General Data Protection Regulation” – “GDPR”). All staff employees and contractors are thus required to comply with the below data protection principles. The organisation has put in place organisational and technical measures to support their due implementation.

Data protection principles

Personal data shall be collected for specific, explicit and legitimate purposes only based on considerations of organisational need and the needs and interests of the data subject. Only data relevant for the specific purpose and for which active consent was obtained may be collected and processed.

  • All personal data shall be processed in a fair and transparent manner.
  • All personal data shall be accurate and be kept up to date. When found to be inaccurate it shall be corrected as soon as possible.
  • Personal data shall only be used for the specified purpose for which active consent was obtained.
  • Personal data which is no longer used for the specified purpose or is known to be inaccurate shall be deleted/destructed or, where deletion is not feasible, access must be restricted so that no one apart from those responsible for technical maintenance of the space it is saved in has access.
  • While business contacts are available to all staff and made available to implementing partners, beneficiaries and contractors as required, access to private and sensitive data is restricted to persons who need access for carrying out their respective function for as long as they carry out this function based on a secure authentication mechanism including strong passwords.
  • Processing activities of personal data owned by ICMPD may only be performed by external parties based on the conclusion of a binding written contract that sets out the purpose and duration of the processing and ensures that the processor meets technical and organisational requirements to ensure the effective protection of the rights of the concerned data subjects.

Rights of data subjects

In line with the GDPR, data subjects have the right to be informed about their personal data that ICMPD and its contractors process, to limit its processing, as well as to request updates or deletion of said data at any time. ICMPD will comply with such requests without undue delay unless this would contradict legal and contractual obligations, such as if the data is required for demonstrating the adequate use of public funds.

JVAP Follow-up portal and subscription to updates

ICMPD is committed to safeguarding the privacy of the users of the JVAP Follow-up portal (www.jvapfollowup.org) and of the subscribers to the JVAP Follow-up updates, while aiming to provide a user-friendly and valuable service. Personal information is only collected via subscription and registration forms. By ticking the box ‘I have read an accept the terms laid down in the legal notice’ on the JVAP Follow-up portal, users and subscribers give consent to ICMPD to process and/or use any personal data in the manner and for the purpose described below in this privacy notice.

During a visit to the portal and subscription to updates, the following types of information are collected: browsing patterns and portal preferences. This information is only used in aggregate forms: statistical reports on number of monthly visits, typical user paths, etc. These reports are used:

  • to monitor the use of the portal
  • to identify audience profiles
  • to support strategic planning.

Logfiles sent by your browser are automatically overwritten after a certain size is reached.

Subscription to JVAP Follow-up updates monitoring is personalised in order to support the evaluation and improvement of the JVAP Follow-up services based on the interest in specific topics by the subscribers to the updates of the JVAP Follow-up. The data is saved on the server of a web-based e-mailing system by CleverReach whose servers are based in the EU guaranteeing the best possible data protection to ICMPD. The JVAP Follow-up portal displays videos, which are hosted on the platform Vimeo. Vimeo is based in the United States and provides services globally using computer systems, servers, and databases located in the U.S. Vimeo complies with GDPR and therefore allows EU users the rights to: opt out of “cookies” (see Vimeo’s Cookie Policy); access, correct, delete, restrict or object to Vimeo’s use of their personal information; be forgotten; and data portability. ICMPD processes personal information collected via the JVAP Follow-up portal and newsletter tool solely for communication purposes of the organisation. Only authorised staff members and contractors bound by the GDPR have access to the information and it will not be shared with any third parties. ICMPD uses secure data networks that are protected by firewall, malware and password protection systems that are consistent with industry standards.

Google Analytics Disclaimer

This portal uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies, which are text files placed on a computer, to help the portal analyse how users use the portal. The information generated by the cookies about your use of the portal will be transmitted to and stored by Google on servers in the United States. IP-anonymisation is activated on this portal. It means that your IP address will be truncated within the area of Member States of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases the whole IP address will be first transferred to a Google server in the USA and truncated there. Google will use this information on behalf of the operator of this portal for the purpose of evaluating your use of the portal, compiling reports on portal activity for portal operators and providing them other services relating to portal activity and internet usage.
